This notice does not cover any other websites accessible via links from this one.

This privacy notice takes inspiration from Recommendation no.2/2001 drafted by the European Data Protection Commissions, via the Working Group set up pursuant to art. 29 of directive no. 95/46/EC, and adopted on May 17, 2001, identifying the minimum requirements for the collection of personal data on-line and, in particular, the timing, the format and the type of information that data controllers should provide to visitors accessing their websites, irrespective of the reasons for such access.

Data Controller and Data Processor

The controller of the processing of your personal data (“Data Contoller” or “Openjobmetis”), for the purposes of the Privacy Code, is Openjobmetis S.p.A. with registered office at 35, Via G. Fara, 20124 Milan (MI). The Data Controller has appointed its Personnel Manager as data processor (“Data Processor”). You may obtain a full list of all the data processors appointed by the Data Controller by contacting the Data Processor at the address indicated in Section 7 of this Policy.

How we use your personal data

We may collect the personal data of visitors to this website interested in using our services and who send us specific requests for such purpose via email or by completing forms posted on the website.

The Data Controller will process such data:

(i) in order to respond to requests for information received from the visitor to the website; and,

(ii) subject to the specific consent of the visitor, in order to send, also by fax and e¬mail, information, newsletters and promotional material concerning Openjobmetis.

See Sections 2, 3, 4, 5 and 6 for information concerning data collected for other purposes.

Who has access to your personal data

Your personal data will be processed by in-house employees and free-lance workers working with Openjobmetis appointed data processors and/or persons in charge of the processing  pursuant to the provisions of the Privacy Code and by third party technical services bound by privacy laws. Personal data collected exclusively for the purposes referred to in the previous paragraph will not be shared with third parties, except companies to which Openjobmetis has outsourced the sending of communications as per (ii) of the preceding paragraph.

What kind of data we process

Data provided voluntarily by the visitor: where a visitor to the website completes a form available on the website or sends an email to an address indicated on a web page,  Openjobmetis will collect some of the visitor’s data, such as his or her e-mail address for replying to requests for information.

Browsing data: the IT systems and software used by this website will as a matter of course collect certain personal data automatically transmitted when you use the Internet, which is based on the TCP/IP protocol.

This information is not collected for association with identified visitors to the website but, by its nature could, in being processed, be associated with data stored by third parties, thus making it possible to identify the website visitor. This category of data includes IP addresses or domain names of computers used by website visitors, URI (Uniform Resource Identifier) of services requested, the time of the request, the method used to send the request to the web server, the size of the file received by way of reply, the code registering the status of the reply given by the web server (ok, error, etc…) and other parameters relating to the operating systems and IT environment of the visitor. This data is used purely for extracting anonymous statistical information concerning use of the website and to check it is working properly. Such data could, however, could be used for seeking parties responsible for cybercrimes causing damage to the Openjobmetis website and for such purpose made available to the police/judicial authorities in connection with their investigations: subject to this, such data is only stored for a few days.

It is your choice whether to give us your personal data

Except for browsing data (which is collected automatically by the IT system), you are under no obligation to provide us with your personal data. However, if you complete forms or send us e-mails requesting information about our services, some data, such as your name and surname, phone number and e-mail and/or postal address, will be indispensable to enable us to supply the service requested. If you do not provide us with your personal data for the above purposes, Openjobmetis cannot provide the service requested. If you do not give your consent to the sending of information and newsletters by fax and e¬mail you will not know about our projects and promotional campaigns.

How we process your data. Security

Your personal data will be processed manually and by automated means, only for as long as necessary in order to meet the purpose, including the maintenance of subsequent contacts with the visitor deriving from his or her request. In particular, in the website sections devoted to specific services, where the visitor’s personal data are requested, the data is encrypted using a security technology called Secure Sockets Layer, or SSL. The SSL technology codifies the information before it is exchanged via the internet between the visitor’s computer and the Openjobmetis IT system making it incomprehensible to non-authorised persons, and thereby  guaranteeing the confidentiality of the data processed. Use of the SSL technology requires a compatible browser capable of “exchanging” a security lock with a minimum length of  128 bit, which is necessary in order to make the said secure connection with the Openjobmetis central IT system.

Your rights and how to enforce them

Your rights pursuant to the Privacy Code are set out in Section 7 of this Policy, which also indicates what you have to do to enforce them.

A complete list of the data processors appointed by the Data Controller is also available by contacting the Data Processor referred to in the same Section 7.

The Browsing data could, by their very nature, enable the identification of the Users even through processing and associations with data possessed by third parties. However, Openjobmetis uses this data for the sole purpose of obtaining statistical and anonymous information on the usage of the App for purposes that are strictly connected to the App's operation.

Data voluntarily supplied by the Users

The User-Workers and Caterers respectively decide, at their own discretion, whether they wish to apply or refuse a mission request or whether to accept or refuse a candidacy. The preliminary acquisition of identification data for the Users-Caterers and the Users-Workers are voluntarily supplied as part of the contract, at the Openjobmetis premises in the presence of company staff assigned to this job in order to establish the User's profile and enable the setting up of the account personally set up and activated for each User.

In particular, with specific reference to the User-Workers, said acquisition takes place at the same premises during a preliminary evaluation, by specially appointed selectors and standard questionnaires, designed to determine the personal qualities and competences (i.e. languages spoken) as well as their professional qualifications (years of experience and specific skills related to the catering business) that will be processed by Openjobmetis – with the User-Worker's approval – in the form of a score from 1 to 5 and used on the App, as detailed below. Furthermore, at this stage, before the issuing of the App and the creation of the account, Openjobmetis via its own appointees may collect a few so called "sensitive" data on User-Workers in order to create and prepare the pay slips, by way of example concerning trade union membership (in order to process the relative subscription payment): this data will be collected by Openjobmetis only when required by the applicable laws, regulations, the National Collective Bargaining Agreements.

Once this preliminary acquisition of the User-Caterers and User-Worker's identification data and the above detailed selection process has been successfully completed, the data requested and wilfully supplied by the Users-Caterers and the Users-Workers, for the purpose of creating the account and in relation to using the App for the pursuit of the purposes illustrated, are:

a) Users – Data required or functional to the Creation of the Account: when the Users register on the App, they will be asked to verify the following personal details: (i) User-Caterer: company name, legal/operating premises with address, position held, applicable National Collective Bargaining Agreement, name of the company contact person, e-mail address, hourly wage offered, amount paid to Openjobmetis, App access password (created autonomously at the time of first access by changing the password automatically generated by the system); (ii) User-Worker: name, surname, data and place of birth, e-mail address, city, reference address, curriculum vitae, days/time slots when available, current working status, App access Password (created autonomously at the time of first access by changing the password automatically generated by the system).

b. User-Worker – Data required and/or essential for the creation of the App functions: some of the data required for the service to function shall be inputted by the User-Worker at the time of first access, like the photo, required to enable the User-Caterer to verify the identity of the subject who turns up at his offices or his premises and which may be modified when necessary by the User-Worker, and the reference address, the territorial range (in kilometres) or the time slots (in times/days) when available, which may be updated when necessary by the User-Worker. This information is necessary to enable the User Worker to apply to the mission proposals offered. The User-Worker's profile is not public, the information that concerns the User-Worker (meaning the photo, the name and the first letter of the surname, the qualifications, and the years of experience, the territorial range and the time slot availability as well as the professional qualifications and the skills reported with a score from 1 to 5 as identified during the selection phase) may only be viewed by the User-Caterer at the time when the User-Worker decides to put forward his candidacy. The conferral of the requested data is entirely voluntary, but necessary in order to be able access the App's services. When uploading the photo, the User-Worker is invited not to supply an image relative or including third persons.

c. User-Caterer – Data required and/or essential for the creation of the App functions; each User-Caterer will independently input mission offers indicating the date and the duration of the same (days and hours, optional hours), premises and working hours, the type of premises (i.e. bar, restaurant), the premises' website if available, the description of the premises, photos of the premises and/or its sign, as well as any additional information relating to the job description and/or the establishment (i.e. specific dress code). Once the User-Caterer has uploaded all the information the App will select the User-Workers – based on qualities and availability (with reference to the territorial range and the time availability inputted by the User-Worker) – who may perform the mission by sending them a notification to forward a candidacy. The User-Caterer may further filter and/or classify the results based on geographic vicinity, the specific skills (i.e. languages, dining hall management, till management, etc.) of each User-Worker. The User-Caterer's profile is not public and may only be viewed by the User-Workers who have been invited to apply for the jobs. The conferral of the requested data is entirely optional, but necessary in order to be able to enjoy the App's services. The "notification" function may be activated or deactivated independently by the users.

d. A backlog of requests, notifications and activities performed: the Users may take advantage of the "backlog" function, through which the Users may visualize the requests sent, the notifications received and the activities performed.

e. Other data supplied voluntarily, within the context of the services provided by the App, the Users may supply additional personal details, in addition to the ones indicated for the purposes described above, for example information supplied in order to receive clarifications, assistance etc. (for example request information, report service disruptions or malfunctions, etc.). This information will be processed by Openjobmetis to enable to respond to the User's requests. The failure to confer them can lead to the impossibility of obtaining the requested service.
